Thomas B. Guthrie

Beginning in the year 1954, Thomas Guthrie served in the capacity of assistant to the President of C.B. GUTHRIE TARIFF BUREAU, Inc.This firm was established in 1912 primarily to serve the "Short Line" railroad industry which at this time consisted of over 500 short line railroads.In 1962, Thomas Guthrie and two of his brothers established Guthrie Bros. Prtg. & Litho Corp. and Guthrie Publications. Guthrie Publications continued the family tradition of tariff publishing, representing railroads, motor carriers, steamship companies, air lines and air freight forwarders, petroleum carriers auto transporters, business and pipe lines. In 1974 Mr. Guthrie sold his interest in these operation in order to move to California in order to pursue a more "hands on" and the day to day operations of trucking firms. Upon his arrival in Los Angeles, Mr. Guthrie was hired by Miller Traffic Services, Inc. While Mr. Guthrie was in the employee of Miller Traffic, which was the leading traffic service in the state at this time, he was schooled in the particulars pertaining to California intrastate trucking by Keith Miller, the dean of California Traffic Consultants. At the time Mr. Guthrie was employed at Miller Traffic, it was at the height of rate and tariff regulation under the control of the California Public Utilities Commission.. Except for regular route common carriers, all rates were under the control of "Minimum Rate Orders" which were published by the state and no increases nor reduction in rates were allowed except by special application, In addition, the Interstate Commerce Commission also strictly controlled rates published by common and contract carriers under their control.In 1975, Mr. Guthrie established a transportation consulting firm, Guthrie & Associates. This firm was established to represent trucking firms mainly in the start up stages, mainly Intrastate Carriers, carriers operating within California only. In the year 1980, the California Legislature passed a Bill that drastically altered California truck regulation. This Assemble Bill took the state out of the rate setting business and placed the burden on the carriers. As a result, Guthrie & Associates became a major player in Intrastate rate Publications. At one time T.B. Guthrie, Agent had 250 to 300 carriers under power of attorneys for rate publications. This was in addition to processing new applications for motor carriers and passenger application for intrastate commerce.In 1995, Assembly bill 1683 was introduced by Assembly Member Conroy, with Assembly Member Katz as the Principal co-author with support of the California Trucking Association. Mr Guthrie changed the name at this time in order to more fully describe the function of the organization, due in part to the many changes taking place in the trucking industry, both nationally and locally in California. The deregulation movement that began with the Motor Carrier Act of 1980, continued in earnest in 1994 and 1995 on the national level.. Public Law 103-305, Preemption of State regulation of intrastate commerce, and enactment of Public Law 104-88, Short Title, "ICC Termination Act of 1995 made certain changes necessary by the California Legislature. Assembly Bill 1683 This act removed the regulation of motor carriers from regulatory control of the California Public Utilities Commission, except for the regulation of Household Goods carriers and Passenger carriers. Public Law 103-305 had the effect of preempting the state of California from regulating intrastate commerce by truck, except as to safety and some area of financial responsibility, insurance requirements. The duties and responsibilities where eliminated from the charter of the California Public Utilities Commission and divided between the California Highway Patrol and the California Department of Motor Vehicles. Those matters left to the state to enforce were safety matters, and were transferred to "The Business and Professions Code" and certain section of the California Vehicle Code. Guthrie Transportation Consultants became involved with the safety issues raised by our clients and advised clients regarding the safety issues and ‘BIT Inspections performed by the CHP. BI-ANNUAL TERMINAL INSPECTIONS Brought about by the fact that safety issues play a major role in transportation within California, Guthrie has had to keep abreast of the changing regulations in this regard and has taken an active role in discussing additional safety legislation and problems and writing several newspaper articles on the mater. As part of the consulting service, carrier may request monthly or quarterly review of their driver log books for accuracy, which have been done on occasion. A major program of Guthrie Transportation Consultants is entitled "ANNUAL DMV/CHP REGULATORY COMPLIANCE SERVICE". This service is available to all carriers members of the service to help our carriers remain in compliance with all safety regulations and Permits remain active. Mr. Guthrie has experience in dealing with the "Harbor and Terminal Exempt" areas and "Intermodal" matters and interchange agreements. Credits: Author of "California Intrastate Deregulation", published in 1994. also various articles on Trucking Deregulation. And the authorship of a new book, "Freight Broker’s handbook". Mr. Guthrie appeared as an expert witness in several cases, his testimony resulted in a $11 million dollar award, and in another case he was able to help a carrier avoid fines and other penalties. PARK PETROLEUM CASE Park Petroleum Co. of Elko, Nevada, conducted a survey of gold ore and possible contamination by Hazardous particles embedded in the ore, carried by open top dump trucks. Also conducted a DOT safety inspection and audit of tank trucks hauling fuel and safety procedures. Prepared briefs defending Park Petroleum against a DOT audit that leveled a fine of over $140,000 due to alleged safety violations.
